Guwahati, Nov 13: The Assam government will move the Gauhati High Court to set up a fast track court in the Zubeen Garg death case after a detailed chargesheet was filed against several accused, Chief Minister Himanta Biswa Sarma said on December 12. The move comes as the case is set to enter the sessions court stage.
Speaking to reporters in Guwahati, Sarma said the state would formally approach the Chief Justice of the Gauhati High Court seeking permission for a fast track court once the case is committed to the sessions court. He added that the government would also appoint a special public prosecutor to handle the trial. According to the chief minister, these steps are part of the legal process the state now needs to follow carefully.
The chargesheet, submitted before the Court of the Chief Judicial Magistrate, runs into over 12,000 pages. Multiple accused have been booked under Section 103 of the Bharatiya Nyaya Sanhita on charges of murder, while one individual has been charged with culpable homicide. Two personal security officers have also been named and face separate charges in connection with the case.
Sarma said the investigation was carried out in a detailed manner, with evidence collected both from within Assam and abroad. While documents were sourced from Singapore, he stressed that the case does not depend solely on foreign material. He said the chargesheet has been prepared in a way that evidence gathered within Assam itself is enough to support the prosecution, even if overseas documents are not accepted by the court.
The chief minister said the government has full faith in the judicial system and respects its independence and fairness. He added that the state will now wait for the court process to move forward.
The case will first be committed to the sessions court, after which the government will formally apply for the fast track court and the appointment of a special public prosecutor.
